Acceptance of Terms
By downloading, installing, or using the Tick Ping Go mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Brainbone LLC ("we," "our," or "us"), the developer and publisher of Tick Ping Go.
Use of the App
Tick Ping Go is licensed to you for personal, non-commercial use on devices you own or control, subject to these Terms and Apple's App Store Terms of Service.
You agree that you will not:
- Copy, modify, or distribute the App or any portion of it
- Reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any part of the App or its related systems
- Remove or alter any proprietary notices or labels on the App
In-App Purchases
The App may offer optional in-app purchases ("Pro" features or other enhancements). All purchases are processed by Apple and are subject to Apple's payment terms. In-app purchases are non-refundable except as required by applicable law or Apple's refund policies.
Intellectual Property
The App, including its design, code, graphics, sounds, and all other content, is owned by Brainbone LLC and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license described herein.
Content you create using the App (your sequences and routines) remains yours. We claim no ownership over data you generate within the App.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRAINBONE LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You use the App at your own risk.
Fitness disclaimer: Tick Ping Go is a timing tool only. It does not provide medical, fitness, or health advice. Always consult a qualified professional before beginning any exercise program. We are not responsible for any injury or health outcome arising from use of the App.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRAINBONE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which Brainbone LLC is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
Changes to Terms
We reserve the right to modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
Termination
We reserve the right to terminate or suspend your access to the App at any time, for any reason, without notice. Upon termination, all licenses granted to you under these Terms will immediately cease.
